End-User License Agreement (EULA) for חייגן אל תתקשר אלי

This End-User License Agreement ("EULA") establishes a legally binding arrangement between yourself and Eyal Stark, the creator of the application named חייגן אל תתקשר אלי ("the App"). Through your installation, access, or utilization of the App, you indicate your consent to comply with the terms and stipulations set forth in this EULA. Should you find yourself unable to agree to these conditions, you must refrain from employing the App.

License Grant Subject to the conditions outlined in this EULA and the minimum prerequisites of the Apple App Store and Google Play Store developer's end-user license agreements, Eyal Stark extends to you a personal, limited license. This license is non-exclusive, non-transferable, and inalienable, granting permission for the App's utilization solely on compatible devices that you own or control.

Subscription Options
The App offers subscription options, which include a yearly subscription for 149 NIS and a monthly subscription for 15 NIS. By opting for either subscription plan, you gain access to specific functionalities and features within the App.

Cancellation via Google Play Menu or Apple Store For users who have subscribed through either the Google Play Store or the Apple App Store, a cancellation mechanism is available within their respective platforms. This facilitates the termination of your subscription based on your preference.

Automatic Subscription Renewal
Please be aware that your subscription to the App will renew automatically unless you choose to cancel. You can cancel your subscription through the Google Play Menu or Apple Store, depending on your initial subscription method.

Use of the App
The App's primary function involves ascertaining whether a given phone number is subject to telemarketing restrictions. This is achieved by accessing and querying the government database known as "אל תתקשר אלי" ("Do Not Call Registry") via an API.

Data Privacy
a. To effectively execute the telemarketing restriction validation, the App may necessitate access to your phone's call log and associated information.
b. The App utilizes an API to transmit the input phone number to the "אל תתקשר אלי" database for verification purposes. It is essential to note that the App neither retains nor stores any of the data derived from this database.

User Consent and Responsibility
a. By utilizing the App, you acknowledge and provide consent for the App to query the "אל תתקשר אלי" database in order to determine the telemarketing restriction status of the provided phone number.
b. You undertake to employ the App in a responsible and lawful manner, refraining from any illicit or unethical activities. You understand and agree that Eyal Stark and חייגן אל תתקשר אלי bear no responsibility for the accuracy, comprehensiveness, or reliability of the data sourced from the "אל תתקשר אלי" database or any other external sources.
c. Through your use of the App, you explicitly accept sole responsibility for any claims, legal actions, liabilities, or damages stemming from your App usage and any calls initiated by you to restricted phone numbers.

Disclaimer of Warranty
a. THE APP IS PROVIDED "AS IS," WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES OR REPRESENTATIONS. EYAL STARK DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO THOSE OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
b. EYAL STARK DOES NOT GUARANTEE THE ACCURACY, RELIABILITY, OR COMPLETENESS OF THE INFORMATION DERIVED FROM THE "אל תתקשר אלי" DATABASE OR THE APP'S FUNCTIONALITY.

Limitation of Liability
a. EYAL STARK SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING FROM THE USE OR INABILITY TO USE THE APP.
b. IN NO EVENT SHALL EYAL STARK'S TOTAL AGGREGATE LIABILITY FOR CLAIMS ARISING FROM THIS EULA EXCEED THE AMOUNT YOU PAID, IF ANY, FOR THE APP.

Indemnification
You agree to indemnify, defend, and hold Eyal Stark, along with its officers, directors, employees, and agents, harmless against any claims, damages, obligations, losses, liabilities, costs, or debts, which encompass legal fees. These are associated with your App usage, breach of this EULA, or infringement of any third-party rights.

Governing Law and Jurisdiction
This EULA adheres to Israeli law and is subject to interpretation in accordance with its principles, excluding conflicts of law. Any disputes connected to this EULA shall be exclusively settled by the courts located in Israel.

Changes to the EULA
Eyal Stark reserves the prerogative to modify, update, or alter this EULA as needed. Such changes take effect immediately upon the posting of the revised EULA version within the App. Your continued use of the App post-changes signifies your consent to these modifications.
Through your utilization of חייגן אל תתקשר אלי, you acknowledge having read and comprehended this EULA and subsequently consent to its terms and conditions.
Should you be in disagreement with the terms outlined in this EULA, you must uninstall the App and cease its usage.
